Creative Commons non-commercial license for profit-websites?

Hi all,

I’m working on a website which is going to make money through affiliate marketing and conventional banner ads. Can I use pictures from Flickr under the CC Non-Commercial licenses family? For example, I would have a page on New York and would have an affiliate link to Expedia.com. On this page I would use a picture under this license. I am ok with linking the picture through to the Flickr website as well as of course naming the source and author but would this kind of use (display on one part and earn revenues on another part of the website) violate against the rules?

That’s an issue that still, literally, up for debate. The Andrew W. Mellon Foundation is currently conducting a study to determine what, exactly, falls under free use for the non-commercial creative commons license. You can read more about that here: http://creativecommons.org/weblog/entry/9557

I’m in a situation similar to yours (I write a blog that contains affiliate links), and I tend to avoid the issue by sticking with CC images that are licensed for commercial use, just to be safe.
